These Terms and Conditions govern purchases made through CustomChenillePatches.com, operated by Varsity Chenille and Apparel, INC. By placing an order through this website, you agree to the terms below. Please review all customization choices, spelling, colors, quantities, sizing, shipping information, and other order details carefully before submitting your order.

1. Custom-Made Products

Most products sold through CustomChenillePatches.com are made or customized specifically for the customer. This may include chenille patches, embroidered patches, varsity letters, names, numbers, letterman jacket decorations, letterman jackets, apparel, and other personalized products.

Because these products are made according to customer selections and specifications, customized merchandise generally cannot be returned, exchanged, or canceled after production has begun except in cases where Varsity Chenille and Apparel, INC made an error or the product is defective.

2. Customer Responsibility for Order Information

Customers are responsible for reviewing all information submitted with an order, including spelling, names, numbers, dates, colors, sizes, quantities, lettering styles, product options, uploaded artwork, shipping addresses, and other customization choices.

Varsity Chenille and Apparel, INC is not responsible for errors resulting from incorrect information supplied or approved by the customer.

3. Product Previews and Online Customization

Product previews and customization tools on this website are provided to help customers visualize their selections. They are intended as a representation of the finished product and should not be considered an exact photographic reproduction.

Variations may occur because of differences in computer monitors, mobile displays, thread and chenille materials, felt colors, leather or vinyl materials, dye lots, manufacturing tolerances, and other production factors.

4. Proofs

Pre-production proofs are not automatically provided with every order. Proofs may be provided when specifically requested by the customer or when Varsity Chenille and Apparel, INC determines that additional approval is appropriate before production.

If a proof is requested or provided, production may be delayed until the customer approves the proof. Customers are responsible for carefully reviewing spelling, colors, layout, design details, and other information shown on the proof before approving it.

Once a customer approves a proof, Varsity Chenille and Apparel, INC is not responsible for errors that were visible in the approved proof.

5. Production Times

Production times shown on this website are estimates based on normal production conditions and begin after all required order information has been received. If a proof is required, production time may begin after proof approval.

Production time is separate from shipping or carrier transit time.

Because our products are custom manufactured, production times may occasionally vary because of order volume, material availability, equipment issues, weather, carrier delays, holidays, or other circumstances.

If we determine that we cannot ship an order within the time originally stated, we will handle the delay in accordance with applicable law, including providing any required notice and cancellation or refund options.

6. Shipping and Delivery

Customers are responsible for providing a complete and accurate shipping address. Additional charges resulting from an incorrect or incomplete address may be the responsibility of the customer.

Shipping estimates provided by carriers are separate from our production time and may be affected by weather, carrier operations, holidays, or other circumstances outside our control.

Once an order has been transferred to the shipping carrier, delivery is subject to the carrier's operations and procedures. Customers should promptly contact us if a package appears lost, damaged, or incorrectly delivered so that we can assist with the carrier when appropriate.

7. Order Changes

Requests to change an order should be made as soon as possible. Changes are not guaranteed once production has begun.

If a requested change requires new artwork, new materials, additional labor, replacement products, or restarting production, additional charges may apply.

8. Order Cancellations

Orders canceled before production begins may be subject to a cancellation fee of up to 15% to cover payment processing, administrative work, artwork preparation, or other costs already incurred.

Custom products generally cannot be canceled after production has begun because materials and labor have already been committed specifically to the customer's order.

This cancellation policy does not limit any cancellation or refund rights that may apply under federal or state law, including circumstances involving shipping delays.

9. Returns and Exchanges

Because most of our products are custom made, personalized merchandise generally cannot be returned or exchanged because of customer preference, incorrect customer-provided information, incorrect size selection, incorrect color selection, spelling errors submitted by the customer, or other customer ordering errors.

Non-custom merchandise, if any, may be subject to separate return conditions stated on the applicable product page.

10. Defective, Damaged, or Incorrect Products

If Varsity Chenille and Apparel, INC makes an error or a product arrives defective or materially different from the order specifications, please contact us promptly after receiving the order.

We may request photographs or other information necessary to evaluate the issue. Depending on the circumstances, we may repair, replace, remake, or refund the affected product as appropriate.

Please do not discard defective or incorrect merchandise until the issue has been reviewed, as we may need the product returned or photographed before providing a resolution.

11. Colors and Material Variations

Colors displayed on computer monitors and mobile devices may differ from actual thread, chenille, felt, leather, vinyl, fabric, and other materials.

Minor variations may also occur between manufacturing runs and dye lots. Exact color matching cannot always be guaranteed unless specifically agreed to in writing.

12. Patch Sizing and Manufacturing Tolerances

Patch dimensions listed on our website generally refer to the primary chenille design unless otherwise stated. Additional felt borders and layers may increase the overall finished size of the patch.

Textile products are subject to normal manufacturing tolerances, and finished dimensions may vary slightly from listed or requested measurements.

13. Customer-Supplied Artwork, Logos, and Trademarks

Customers may submit names, logos, mascots, trademarks, artwork, photographs, or other materials for reproduction on custom products.

By submitting such materials, the customer represents that they own the material or have permission or other legal authority to authorize Varsity Chenille and Apparel, INC to reproduce it for the purpose of completing the customer's order.

The customer is responsible for claims arising from materials they provide without proper authorization.

14. Copyright, Artwork, and Intellectual Property

Unless otherwise stated, original patch designs, artwork, product images, photographs, graphics, illustrations, written content, page layouts, logos, production files, digitized embroidery files, chenille patterns, and other original materials created by or for Varsity Chenille and Apparel, INC remain the property of Varsity Chenille and Apparel, INC or their respective licensors.

The purchase of a physical product does not transfer ownership of underlying artwork, digitizing files, embroidery files, production files, chenille patterns, photographs, graphics, or other intellectual property unless a separate written agreement specifically provides otherwise.

Materials displayed on this website may not be copied, reproduced, redistributed, traced, digitized, modified, republished, used to manufacture competing products, or otherwise used for commercial purposes without prior written permission from Varsity Chenille and Apparel, INC, except where such use is permitted by law.

15. Website Images and Product Examples

Photographs, artwork, and product examples shown on this website may include designs created for customers, schools, teams, organizations, or other parties.

Display of a logo, mascot, trademark, or other third-party material on this website does not necessarily indicate ownership of that intellectual property by Varsity Chenille and Apparel, INC.

16. Pricing

Prices, product options, promotions, and availability are subject to change. The price charged for an order will generally be the price shown at the time the order is placed, subject to correction of obvious typographical, technical, or pricing errors.

If a material pricing error is discovered after an order is submitted, we may contact the customer to explain the issue and provide available options before proceeding.

17. Payment

Payment is generally required before custom production begins unless other arrangements have been approved in writing.

Customers agree to provide accurate billing and payment information and represent that they are authorized to use the payment method submitted with the order.

18. Chargebacks and Payment Disputes

Customers who believe there is a problem with an order are encouraged to contact us before initiating a payment dispute so that we have an opportunity to investigate and resolve the issue.

Nothing in these Terms limits any rights a customer may have under applicable credit card, banking, consumer protection, or other laws.

19. Availability and Discontinued Products

Product designs, materials, colors, sizes, and options may be changed or discontinued at any time. If an ordered material or option becomes unavailable, we may contact the customer to discuss an appropriate substitute, modification, delay, cancellation, or refund where applicable.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Varsity Chenille and Apparel, INC will not be responsible for indirect, incidental, special, or consequential damages arising from the purchase or use of products or use of this website.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

21. Website Availability and Errors

We attempt to keep product descriptions, pricing, images, availability, and other website information accurate. However, typographical errors, technical errors, outdated information, or website interruptions may occasionally occur.

We reserve the right to correct errors and update website information when discovered.

22. Governing Law

These Terms and Conditions and transactions with Varsity Chenille and Apparel, INC are governed by applicable federal law and the laws of the State of Texas, without regard to conflict-of-law principles, except where another law must apply.

23. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

24. Changes to These Terms

We may update these Terms and Conditions from time to time. The version posted on this website at the time an order is placed will generally apply to that order unless otherwise required by law.
